The use of standard JBCC & MBSA Subcontract agreements makes contracting easier and protects both the subcontractor and main contractor.

MBA North has created practical training for contractors to understand, use these agreements & protect their rights within the contracts.

Even though this is a NON-CPD accredited course, it is a hands-on training of the document, to ensure that those who attended the training are well versed in the JBCC N/S Subcontract and the MBSA Domestic Subcontract documents.

JBCC N/S Subcontract Agreement 2014 and MBSA (Master Builders South Africa) Domestic Subcontract 2014 Training:  

Some topics covered int his half day seminar include:

  • – Importance of contracting & written agreements;
  • – Design responsibility;
  • – Remedies given to Contractors when Clients delay or breach;
  • – Payments & Securities;
  • – Variations;
  • – Stages of completion with particular focus on practical completion
  • – Damages for non-performance vs penalties;
  • – Termination of agreement.
  • – Principal Agents vs working directly with Clients

Once you have completed this workshop, you should:  

  • Be aware of the structure of the JBCC and / or MBSA documents;
  • Have an understanding of areas which call for special attention when contracting
  • under JBCC; &
  • Be able to apply the knowledge gained on any JBCC project you work on.

In particular, you should gain an understanding of the following important contractual matters: 

  • Payment guarantees:  When does the contractor get these?
  • Design responsibility:  Who is liable when a contractor does design work?
  • Security:  Retention vs payment reduction;
  • Employer’s agent:  What role does the employer’s agent serve under the contract agreement?
  • Contractors claims, with focus on the procedure to be followed when claiming;
  • Interim payment by the Client & Termination of the contract agreement
